AugiHealth, Inc. (the “Augi” or “We”) respects your privacy and is committed to protecting it through our compliance with this policy. This policy describes:

This policy applies only to information we collect in this App and in email, text and other electronic communications sent through or in connection with this App.

Our websites and apps, and these other third parties may have their own privacy policies, which we encourage you to read before providing information on or through them.
Please read this policy carefully to understand our policies and practices regarding your information and how we will treat it. If you do not agree with our policies and practices, do not download, create an account, or use this App. By downloading, creating an account, or using this App, you agree to this privacy policy. This policy may change from time to time. Your continued use of this App after we revise this policy means you accept those changes, so please check the policy periodically for updates.

Information You Provide to Us
When you download, create an account, or use this App, we may ask you to provide information:
By which you may be personally identified, such as name, postal address, email address, telephone number, driver’s license number, state-issued identification card number, financial account number, credit card number, debit card number, with or without any required security code, access code, or password that would permit access to a resident’s financial account, Social Security number, or any other identifier by which you may be contacted online or offline (personal information).
That is related to your personal health records (“Health Records”), including:
Information about your medical history, including information about your healthcare providers and the institutions where you have received care;
Health insurance information;
Information that you self-report about your health;
Other instances when you choose to provide us with certain information or have us collect information on your behalf.
That is about you but individually does not identify you, including but not limited to IP addresses or unique device IDs either directly by Augi or through third parties.
We will only collect the above categories of information to the extent that you either affirmatively provide it or if you provide us with permission or authorization to retrieve such information on your behalf.
This information includes:
Information that you provide by filling in forms in the App. This includes information provided at the time of creating an account on the App, subscribing to our service, posting material and requesting further services. We may also ask you for information when you enter a contest or promotion sponsored by us, and when you report a problem with the App.
Records and copies of your correspondence (including email addresses and phone numbers), if you contact us.
Your responses to surveys that we might ask you to complete for research purposes.
Details of transactions you carry out through the App and of the fulfillment of your orders. You may be required to provide financial information before placing an order through the App.
Your search queries on the App.
You may also provide information for publication or display (“Posted”) on public areas of the app or websites you access through the App or AugiHealth.com (collectively, the “User Contributions”). Your User Contributions are Posted and transmitted to others at your own risk. Please be aware that no security measures are perfect or impenetrable. Additionally, we cannot control the actions of third parties with whom you may choose to share your User Contributions. Therefore, we cannot and do not guarantee that your User Contributions will not be viewed by unauthorized persons.
Information We Collect Through Automatic Data Collection Technologies
As you navigate through and interact with our App, including when you download, access, or use the App, we may use automatic data collection technologies to collect certain information about your device and your browsing and usage activity and patterns, including:
Usage Details. When you access and use the App, we may automatically collect certain details of your access to and use of the App, including traffic data, logs, and other communication data and the resources that you access and use on or through the App.
Stored Information and Files. The App also may access metadata and other information associated with other files stored on your device. This may include, for example, photographs, audio and video clips, personal contacts, and address book information.
Augi operates on an opt-in basis and will only collect data that you have consented to give. For more information, see Augihealth.com/TermsAndConditions.
We also may use these technologies to collect information about your activities over time and across third-party websites, apps, or other online services (behavioral tracking). Click here Augihealth.com/TermsAndConditions for information on our opt-in policies.
The technologies we use for automatic information collection may include:
Cookies (or mobile cookies). A cookie is a small file placed on your smartphone. A cookie allows the App to recognize whether you have visited before and may store user preferences and other information. For example, cookies can be used to collect or store information about your use of the App during your current session and over time (including the pages you view and the files you download), your smartphone’s operating system and browser type, your Internet service provider, your domain name and IP address, your general geographic location, the website you visited before visiting the App, and the link you used to leave the App. If you are concerned about having cookies on your smartphone, it may be possible to refuse to accept mobile cookies by activating the appropriate setting on your smartphone. You can also delete cookies from your smartphone. However, if you choose to block or delete cookies, you may be unable to access certain parts of our App.
We do not collect personal information automatically, but we may tie non-personal information collected automatically to personal information about you that we collect from other sources or that you provide to us.
Third-Party Information Collection
When you use the App or its content, certain third parties may use automatic information collection technologies to collect information about you or your device.
We may partner with certain third parties. For example, we may allow third parties to set cookies or use web beacons on the App or in email communications from us. These third parties may use tracking technologies to collect information about you when you use this App. The information they collect may be associated with your personal information or they may collect information, including personal information, about your online activities over time and across different websites, apps, and other online services websites. They may use this information to provide you with interest-based (behavioral) advertising or other targeted content.
We do not control these third parties’ tracking technologies or how they may be used. If you have any questions about an advertisement or other targeted content, you should contact the responsible provider directly.
As described further below, certain App features rely on third-party large language models (LLMs) such as OpenAI to deliver personalized services. These partners may receive limited data inputs solely for functionality purposes, and do not use such data for advertising.
How We Use Your Information
We use information that we collect about you or that you provide to us, including any personal information, for a variety of purposes. Our legal bases for processing your personal information are: 1) our legitimate interest in running and maintaining our business; 2) performance and fulfillment of our contracts; 3) your consent; and 4) compliance with our legal obligations. In many instances, more than one of these legal bases apply to the processing of your personal information. The purposes for which we use your information include to:
Provide you with access to our App;
Respond to your questions or requests concerning the App;
Fulfill the terms of any agreement you have with us;
Fulfill your requests for our App or otherwise complete a transaction that you initiate;
Send you information about our App and other topics that are likely to be of interest to you, including newsletters, updates, or other communications, including promotional emails;
Improve our artificial intelligence and machine learning capabilities;
Deliver confirmations, account information, notifications, and similar operational communications;
Improve your user experience and the quality of our products and App;
Comply with legal and/or regulatory requirements;
Aggregate and deidentify information;
Serve advertisements;
Analyze how visitors use the App and its various features, including to count and recognize visitors to the App;
Create new products and services; and
Manage our business.
We may link information gathered through the App with information that we collect in other contexts. But in that event, we will handle the combined information in a manner consistent with this Policy.
The Company uses third-party service providers that perform services on our behalf, including web-hosting companies, mailing vendors, and analytics providers. These service providers may collect and/or use your information, including information that identifies you personally, to assist us in achieving the purposes discussed above.
We partner with certain third parties to obtain the automatically collected information discussed above and to engage in analysis, auditing, research, and reporting. These third parties may use web logs or web beacons, and they may set and access cookies on your smartphone or other device.
The App also enables third-party tracking mechanisms to collect information about you and your devices for use in online interest-based advertising. For example, third parties may use the fact that you used our App to target online ads to you. In addition, our third-party advertising networks might use information about your use of our App to help target advertisements based on your online activity in general.
The use of online tracking mechanisms by third parties is subject to those third parties’ privacy policies, and not this policy. If you prefer to prevent third parties from setting and accessing cookies on your smartphone or other device, you may set your browser to block cookies.
We may also use your information to contact you about our own and third parties’ goods and services that may be of interest to you. For information on our opt-in policy, see Augihealth.com/TermsAndConditions.
By using the App, you acknowledge and agree that certain features of the platform are powered by third-party LLMs, including services provided by OpenAI. These AI-powered features are integral to enhancing your experience across functionalities such as generating personal data synopses, calendar integration, personalized program development, and other support services.
Please note that OpenAI and similar LLM providers are not currently certified as HIPAA-compliant.
Use of AI-powered services is subject to your express opt-in consent at the time of onboarding. By checking the applicable box during account creation, you agree to the use of third-party AI services as described herein.
Disclosure of Your Information
We may disclose aggregated or de-identified information about our users, and information that does not identify any individual or device, without restriction.
In addition, we may disclose personal information that we collect or you provide:
To our subsidiaries and affiliates.
To contractors, service providers, and other third parties we use to support our business.
To a buyer or other successor in the event of a merger, divestiture, restructuring, reorganization, dissolution, or other sale or transfer of some or all of Augi’s assets, whether as a going concern or as part of bankruptcy, liquidation, or similar proceeding, in which personal information held by Augi about our App users is among the assets transferred.

To fulfill the purpose for which you provide it.
For any other purpose disclosed by us when you provide the information.
With your consent.
We may also disclose your personal information:
To comply with any court order, law, or legal process, including to respond to any government or regulatory request.
To investigate, prevent, or take action regarding illegal activities, suspected fraud, violations of our terms and conditions, or situations involving threats to our property or the property or physical safety of any person or third party;
To establish, protect, or exercise our legal rights or defend against legal claims;
To facilitate the financing, securitization, insuring, sale, assignment, bankruptcy, or other disposal of all or part of our business or assets; or
To enforce our rights arising from any contracts entered into between you and us, including the Terms of Service, located at Augihealth.com/TermsAndConditions, and for billing and collection.
Choices About How We Use and Disclose Your Information
We strive to provide you with choices regarding the personal information you provide to us. This section describes mechanisms we provide for you to control certain uses and disclosures of over your information.
Tracking Technologies. You can set your browser or device to refuse all or some browser cookies or to alert you when cookies are being sent. For information collected through other tracking technologies and our opt-in policy, see Augihealth.com/TermsAndConditions. We do not use tracking technologies to collect health-related or sensitive data unless explicitly authorized by you. Any information collected is securely stored and used only for the purposes disclosed in this privacy policy.
Promotion by the Company. We may use your contact information to promote our own or third parties’ products or services. For information on our opt-in policy, see Augihealth.com/TermsAndConditions.
Targeted Advertising by the Company. We may use information that we collect or that you provide to us to deliver advertisements according to our advertisers’ target-audience preferences. Your health data will not be shared unless explicitly authorized.
Disclosure of Your Information for Third-Party Advertising and Marketing. We may share your personal information with unaffiliated or non-agent third parties for advertising and marketing purposes. We do not control third parties’ collection or use of your information to serve interest-based advertising. However, we take steps to ensure that any third-party tracking technologies integrated with our App comply with applicable privacy laws and best practices. Massachusetts residents are protected by state laws that require businesses to implement robust data security measures for personal information. We comply with these regulations to safeguard your personal and health-related data. Accessing and Correcting Your Personal Information
You can review and change your personal information by logging into the App and visiting your account profile page.
You may also send us an email at notice@augihealth.com to request access to, correct, or delete any personal information that you have provided to us. We cannot delete your personal information except by also deleting your user account. Some information may remain in cached or archived pages, or may have been copied or stored by other users or third parties. We may not accommodate a request to change information if we believe the change would violate any law or legal requirement or cause the information to be incorrect.

Your State Privacy Rights
State consumer privacy laws may provide their residents with additional rights regarding our use of their personal information.
Many states, including California, Colorado, Connecticut, Delaware, Florida, Indiana, Iowa, Montana, Oregon, Tennessee, Texas, Utah, and Virginia provide (now or in the future) their state residents with rights to:
Confirm whether we process their personal information.
Access and delete certain personal information.
Correct inaccuracies in their personal information, taking into account the information’s nature processing purpose (excluding Iowa and Utah).
Data portability.
Opt-out of personal data processing for:

California Privacy Notice
If you are a California resident, the California Consumer Privacy Act and the California Privacy Rights Act (collectively, the “CCPA”) provide you with certain rights regarding your personal information, including the right to know about personal information collected, disclosed, or sold; the right to request that we delete personal information that we have collected from you; the right to update or correct your information; the right to opt-out of the sale or sharing of your personal information; the right to limit our use of your sensitive personal information; and the right not to be discriminated against for exercising your rights. These rights are subject to certain exceptions.
Any capitalized terms in this California Privacy Notice that are not otherwise defined have the same meaning as they do in the CCPA or our Privacy Policy.
This California Privacy Notice also serves as our “Notice at Collection” for purposes of the CCPA.
If you visit, use, or interact with our App, we may collect information that identifies, relates to, describes, is reasonably capable of being associated with, or could reasonably be linked, directly or indirectly, with a particular consumer or household (“personal information”). Analytics providers, to help analyze the data that we collect.
Your healthcare provider or insurer, at your direction.
Our affiliates, subsidiaries, and parent companies.
Other third parties for a legal purpose (such as in response to a court order or to defend against a legal claim).
Other third parties when necessary to investigate, prevent, or take action regarding illegal activities, suspected fraud, violations of our terms and conditions, or situations involving threats to our property or the property or physical safety of any person or third party.
Other third parties when necessary to fulfill your requests for services; to complete a transaction that you initiate; to meet the terms of any agreement that you have with us or our partners; or to manage our business.
We may collect, use, or disclose your personal information to the entities listed above for the following purposes:
Provide you with access to our App;
Facilitate business transitions, such as a merger, acquisition by another company, or sale of all or a portion of our assets;

If we maintain personal information about you that is subject to the CCPA, you may exercise certain rights in connection with this data if you are a California resident.
California residents have the right to request that we disclose certain information about our collection and use of your personal information over the past twelve months (“Right to Know”). Once we receive and confirm your verifiable consumer request, we will disclose to you:
The categories of personal information we collected about you.
The categories of sources for the personal information we collected about you.
The categories of personal information that we have disclosed for a business or commercial purpose.
Our business or commercial purposes for collecting, selling, or sharing personal information.
The categories of third parties with whom we share or disclose that personal information.
The specific pieces of personal information we collected about you (i.e., a data portability request).
California residents have the right to request that we delete the personal information that we collected from you and retain, subject to certain exceptions (“Right to Delete”). Once we receive and verify your request, we will delete (and direct our service providers/contractors to delete) your personal information from our records, unless an exception applies.
The CCPA provides California residents with the right to opt-out of the “sale” or “sharing” of their personal information (“Right to Opt Out”). We do not sell or share your personal information. We do not have actual knowledge that we sell or share the personal information of California residents under the age of 16.
The CCPA provides California residents with the right to limit (“Right to Limit”) the use of their “sensitive personal information” to the purposes outlined in Cal. Code Regs. tit. 11, § 7027(m) of the CCPA regulations. We do not use your personal information for purposes that require us to provide a Right to Limit.
The CCPA provides California residents with the right not to receive discriminatory treatment for the exercise of their privacy rights conferred by the CCPA. We will not discriminate against you for exercising any of your CCPA rights.

When you submit a request, we will confirm your identity by asking you to provide information associated with what we have on file for you, including your name, email address, and other identifying information. We may ask you for additional information to verify your identity or to comply with your request.
You may authorize an agent to make a request on your behalf. To designate an agent, please provide a written and signed document by both you and the agent that authorizes the agent to act on your behalf. You may also use a power of attorney. We will still require you to provide information to allow us to reasonably verify that you are the person about whom we collected personal information. We retain personal information about you necessary to fulfill the purpose for which that information was collected or as required or permitted by law. We do not retain personal information longer than is necessary for us to achieve the purposes for which we collected it. When we destroy your personal information, we do so in a way that prevents that information from being restored or reconstructed.
In addition to the CCPA, California's "Shine the Light" law, Civil Code section 1798.83, requires certain businesses to respond to requests from California customers asking about the businesses' practices related to disclosing personal information to third parties for the third parties' direct marketing purposes. We do not disclose your personal information for these purposes.

Consumer Health Data Privacy Notice
This Consumer Health Data Privacy Notice applies specifically to Consumer Health Data collected and processed by the Company through the App.
For purposes of this notice, the following definitions shall apply:
“Consumer Health Data” means Personal Information that is linked or reasonably linkable to a consumer and that identifies the consumer's past, present, or future physical or mental health status. It includes any information that is regulated as “consumer health data” under Washington’s My Health My Data Act and similar health privacy laws in effect in other jurisdictions.
“Personal Information” means information that identifies or is reasonably capable of being associated or linked, directly or indirectly, with a particular consumer. “Personal Information” does not include non-identified information or information that is reported in the aggregate (provided that such aggregated information is not identifiable to a natural person).
We collect information from you when you provide it to us in relation to our App. This may include the following categories of Consumer Health Data:
Health conditions, treatment, diseases, or diagnosis;
Social, psychological, behavioral, and medical interventions;
Health-related surgeries or procedures;
Use or purchase of prescribed medication;
Bodily functions, vital signs, symptoms, or other health-related measurements;
Diagnoses or diagnostic testing, treatment, or medication;
Gender-affirming care information;
Reproductive or sexual health information;
Genetic data;
Precise location information that could reasonably indicate your attempt to acquire or receive health services or supplies;
Data that identifies individuals seeking health care services; and
Information that we derive from nonhealth data to associate or identify individuals with any of the categories of Consumer Health Data identified above.
We collect the above categories of Consumer Health Data for the following purposes:
Provide you with our App and respond to your questions or requests concerning the App;
Fulfill the terms of any agreement you have with us;
Fulfill your requests for our App or otherwise complete a transaction that you initiate;
Send you information about our App and other topics that are likely to be of interest to you, including newsletters, updates, or other communications, including promotional emails;
Improve our artificial intelligence and machine learning capabilities;
Deliver confirmations, account information, notifications, and similar operational communications;
Improve your user experience and the quality of our products and App;
Comply with legal and/or regulatory requirements;
Aggregate and deidentify information;
Serve advertisements.
We only collect the above categories of Consumer Health Data from the following sources:
From you directly when you provide it to us via the App; and
From your provider, a mobile health app, or other source of consumer health data if you provide us with permission or authorization to retrieve such information on your behalf.
We may share any of the categories of Consumer Health Data described above. We may share these categories of Consumer Health Data with the following categories of third parties and specific affiliates:
Our service providers and agents in connection with services or business purposes that these individuals or entities perform for, or with, the Company. These third-party service providers can include web-hosting companies, mailing vendors, and analytics providers. We may, for example, provide your Consumer Health Data to a service provider to send you information that you requested.
In some cases, the Company may disclose Consumer Health Data (i) if required to do so by law, court order or legal process, (ii) in response to lawful requests by public authorities, including to meet national security or law enforcement requirements, (iii) under the discovery process in litigation, or (iv) when we believe disclosure is necessary or appropriate to prevent physical harm or financial loss or in connection with an investigation or prosecution of suspected or actual illegal activity. The Company also may transfer Consumer Health Data when a material event concerning its business operation(s), assets or shares, such as purchase, disposal, merger, joint venture or acquisition, is proposed or occurs.
In accordance with applicable law, you may have the following rights in relation to your Consumer Health Data:
The right to confirm whether we are collecting, sharing, or selling your Consumer Health Data;
The right to access your Consumer Health Data, including a list of all third parties and affiliates with whom we have shared or sold the Consumer Health Data and an active email address or other online mechanism that you may use to contact these third parties;
The right to withdraw consent for our collection, sharing, and selling of your Consumer Health Data;
The right to delete your Consumer Health Data; and
The right to correct or amend any Consumer Health Data that we have on file about you.
To exercise any of these rights, please contact us by email at notice@augihealth.com with your name, the email address associated with your interactions with the Company (if different), and details about your interactions with the Company. You may also designate an authorized agent to submit a request on your behalf. To designate an agent, please also send us a written and signed document by both you and the agent that authorizes the agent to act on your behalf. You may also use a power of attorney. Please note that we will still require you to provide sufficient information to allow us to reasonably verify that you are the person about whom we are receiving a request. We will respond to any request you submit in the time period required by applicable law and will allow you to appeal any decision we make in response to such request in accordance with applicable law. If we deny your request and your information is protected by Washington’s My Health My Data Act, you may file a complaint to the Washington Attorney General’s office through this link: https://www.atg.wa.gov/file-complaint.
Data Security
We have implemented measures designed to secure your personal information from accidental loss and from unauthorized access, use, alteration, and disclosure. All information you provide to us is encrypted and stored in HIPAA compliant cloud servers with multiple layers of security. All financial transactions made in connection with the service will be processed by a third party in accordance with their respective terms of use, privacy policy, and/or any applicable payment terms and conditions. We encourage you to learn about the practices of such third party. In no event will Augi be responsible for the actions or inactions of any third party payment processor.
The safety and security of your information also depends on you. Where we have given you (or where you have chosen) a password for access to certain parts of our App, you are responsible for keeping this password confidential. We ask you not to share your password with anyone.
Unfortunately, the transmission of information via the internet and mobile platforms is not completely secure. Although we do our best to protect your personal information, we cannot guarantee the security of your personal information transmitted through our App. Any transmission of personal information is at your own risk. We are not responsible for circumvention of any privacy settings or security measures included through the App.
Data Retention
We will retain your personal information for as long as is reasonably necessary to fulfill the relevant purposes set out in this policy and during the period required or permitted by law. The retention period will primarily be determined by relevant legal and regulatory obligations and/or duration of our business relationship with you. We will securely delete or erase your personal information if there is no valid business reason for retaining your data.
Changes to Our Privacy Policy

Information that you provide by filling in forms in the App. This includes information provided at the time of creating an account on the App, subscribing to our service, posting material and requesting further services. We may also ask you for information when you enter a contest or promotion sponsored by us, and when you report a problem with the App.
Records and copies of your correspondence (including email addresses and phone numbers), if you contact us.
Your responses to surveys that we might ask you to complete for research purposes.
Details of transactions you carry out through the App and of the fulfillment of your orders. You may be required to provide financial information before placing an order through the App.
Your search queries on the App.
You may also provide information for publication or display (“Posted”) on public areas of the app or websites you access through the App or AugiHealth.com (collectively, the “User Contributions”). Your User Contributions are Posted and transmitted to others at your own risk. Please be aware that no security measures are perfect or impenetrable. Additionally, we cannot control the actions of third parties with whom you may choose to share your User Contributions. Therefore, we cannot and do not guarantee that your User Contributions will not be viewed by unauthorized persons.
Information We Collect Through Automatic Data Collection Technologies
As you navigate through and interact with our App, including when you download, access, or use the App, we may use automatic data collection technologies to collect certain information about your device and your browsing and usage activity and patterns, including:
Usage Details. When you access and use the App, we may automatically collect certain details of your access to and use of the App, including traffic data, logs, and other communication data and the resources that you access and use on or through the App.
Stored Information and Files. The App also may access metadata and other information associated with other files stored on your device. This may include, for example, photographs, audio and video clips, personal contacts, and address book information.

The technologies we use for automatic information collection may include:
Cookies (or mobile cookies). A cookie is a small file placed on your smartphone. A cookie allows the App to recognize whether you have visited before and may store user preferences and other information. For example, cookies can be used to collect or store information about your use of the App during your current session and over time (including the pages you view and the files you download), your smartphone’s operating system and browser type, your Internet service provider, your domain name and IP address, your general geographic location, the website you visited before visiting the App, and the link you used to leave the App. If you are concerned about having cookies on your smartphone, it may be possible to refuse to accept mobile cookies by activating the appropriate setting on your smartphone. You can also delete cookies from your smartphone. However, if you choose to block or delete cookies, you may be unable to access certain parts of our App.
We do not collect personal information automatically, but we may tie non-personal information collected automatically to personal information about you that we collect from other sources or that you provide to us.
Third-Party Information Collection
When you use the App or its content, certain third parties may use automatic information collection technologies to collect information about you or your device.
We may partner with certain third parties. For example, we may allow third parties to set cookies or use web beacons on the App or in email communications from us. These third parties may use tracking technologies to collect information about you when you use this App. The information they collect may be associated with your personal information or they may collect information, including personal information, about your online activities over time and across different websites, apps, and other online services websites. They may use this information to provide you with interest-based (behavioral) advertising or other targeted content.
We do not control these third parties’ tracking technologies or how they may be used. If you have any questions about an advertisement or other targeted content, you should contact the responsible provider directly.
As described further below, certain App features rely on third-party large language models (LLMs) such as OpenAI to deliver personalized services. These partners may receive limited data inputs solely for functionality purposes, and do not use such data for advertising.
How We Use Your Information
We use information that we collect about you or that you provide to us, including any personal information, for a variety of purposes. Our legal bases for processing your personal information are: 1) our legitimate interest in running and maintaining our business; 2) performance and fulfillment of our contracts; 3) your consent; and 4) compliance with our legal obligations. In many instances, more than one of these legal bases apply to the processing of your personal information. The purposes for which we use your information include to:
Provide you with access to our App;
Respond to your questions or requests concerning the App;
Fulfill the terms of any agreement you have with us;
Fulfill your requests for our App or otherwise complete a transaction that you initiate;
Send you information about our App and other topics that are likely to be of interest to you, including newsletters, updates, or other communications, including promotional emails;
Improve our artificial intelligence and machine learning capabilities;
Deliver confirmations, account information, notifications, and similar operational communications;
Improve your user experience and the quality of our products and App;
Comply with legal and/or regulatory requirements;
Aggregate and deidentify information;
Serve advertisements;
Analyze how visitors use the App and its various features, including to count and recognize visitors to the App;
Create new products and services; and
Manage our business.
We may link information gathered through the App with information that we collect in other contexts. But in that event, we will handle the combined information in a manner consistent with this Policy.
The Company uses third-party service providers that perform services on our behalf, including web-hosting companies, mailing vendors, and analytics providers. These service providers may collect and/or use your information, including information that identifies you personally, to assist us in achieving the purposes discussed above.
We partner with certain third parties to obtain the automatically collected information discussed above and to engage in analysis, auditing, research, and reporting. These third parties may use web logs or web beacons, and they may set and access cookies on your smartphone or other device.
The App also enables third-party tracking mechanisms to collect information about you and your devices for use in online interest-based advertising. For example, third parties may use the fact that you used our App to target online ads to you. In addition, our third-party advertising networks might use information about your use of our App to help target advertisements based on your online activity in general.
The use of online tracking mechanisms by third parties is subject to those third parties’ privacy policies, and not this policy. If you prefer to prevent third parties from setting and accessing cookies on your smartphone or other device, you may set your browser to block cookies.

By using the App, you acknowledge and agree that certain features of the platform are powered by third-party LLMs, including services provided by OpenAI. These AI-powered features are integral to enhancing your experience across functionalities such as generating personal data synopses, calendar integration, personalized program development, and other support services.
Please note that OpenAI and similar LLM providers are not currently certified as HIPAA-compliant.
Use of AI-powered services is subject to your express opt-in consent at the time of onboarding. By checking the applicable box during account creation, you agree to the use of third-party AI services as described herein.
Disclosure of Your Information
We may disclose aggregated or de-identified information about our users, and information that does not identify any individual or device, without restriction.
In addition, we may disclose personal information that we collect or you provide:
To our subsidiaries and affiliates.
To contractors, service providers, and other third parties we use to support our business.

We do not control third parties’ collection or use of your information to serve interest-based advertising. Accessing and Correcting Your Personal Information
You can review and change your personal information by logging into the App and visiting your account profile page.

We cannot delete your personal information except by also deleting your user account. Some information may remain in cached or archived pages, or may have been copied or stored by other users or third parties. We may not accommodate a request to change information if we believe the change would violate any law or legal requirement or cause the information to be incorrect.

Your State Privacy Rights
State consumer privacy laws may provide their residents with additional rights regarding our use of their personal information.

If you are a California resident, the California Consumer Privacy Act and the California Privacy Rights Act (collectively, the “CCPA”) provide you with certain rights regarding your personal information, including the right to know about personal information collected, disclosed, or sold; the right to request that we delete personal information that we have collected from you; the right to update or correct your information; the right to opt-out of the sale or sharing of your personal information; the right to limit our use of your sensitive personal information; and the right not to be discriminated against for exercising your rights. California residents have the right to request that we delete the personal information that we collected from you and retain, subject to certain exceptions (“Right to Delete”). Once we receive and verify your request, we will delete (and direct our service providers/contractors to delete) your personal information from our records, unless an exception applies.
The CCPA provides California residents with the right to opt-out of the “sale” or “sharing” of their personal information (“Right to Opt Out”). We do not sell or share your personal information. We do not have actual knowledge that we sell or share the personal information of California residents under the age of 16.
The CCPA provides California residents with the right to limit (“Right to Limit”) the use of their “sensitive personal information” to the purposes outlined in Cal. Code Regs. tit. 11, § 7027(m) of the CCPA regulations. We do not use your personal information for purposes that require us to provide a Right to Limit.
The CCPA provides California residents with the right not to receive discriminatory treatment for the exercise of their privacy rights conferred by the CCPA. We will not discriminate against you for exercising any of your CCPA rights.

When you submit a request, we will confirm your identity by asking you to provide information associated with what we have on file for you, including your name, email address, and other identifying information. We may ask you for additional information to verify your identity or to comply with your request.
You may authorize an agent to make a request on your behalf. To designate an agent, please provide a written and signed document by both you and the agent that authorizes the agent to act on your behalf. You may also use a power of attorney. We will still require you to provide information to allow us to reasonably verify that you are the person about whom we collected personal information. We retain personal information about you necessary to fulfill the purpose for which that information was collected or as required or permitted by law. We do not retain personal information longer than is necessary for us to achieve the purposes for which we collected it. When we destroy your personal information, we do so in a way that prevents that information from being restored or reconstructed.
In addition to the CCPA, California's "Shine the Light" law, Civil Code section 1798.83, requires certain businesses to respond to requests from California customers asking about the businesses' practices related to disclosing personal information to third parties for the third parties' direct marketing purposes. We do not disclose your personal information for these purposes.

Consumer Health Data Privacy Notice
This Consumer Health Data Privacy Notice applies specifically to Consumer Health Data collected and processed by the Company through the App.
For purposes of this notice, the following definitions shall apply:
“Consumer Health Data” means Personal Information that is linked or reasonably linkable to a consumer and that identifies the consumer's past, present, or future physical or mental health status. It includes any information that is regulated as “consumer health data” under Washington’s My Health My Data Act and similar health privacy laws in effect in other jurisdictions.
“Personal Information” means information that identifies or is reasonably capable of being associated or linked, directly or indirectly, with a particular consumer. “Personal Information” does not include non-identified information or information that is reported in the aggregate (provided that such aggregated information is not identifiable to a natural person).
We collect information from you when you provide it to us in relation to our App. This may include the following categories of Consumer Health Data:
Health conditions, treatment, diseases, or diagnosis;
Social, psychological, behavioral, and medical interventions;
Health-related surgeries or procedures;
Use or purchase of prescribed medication;
Bodily functions, vital signs, symptoms, or other health-related measurements;
Diagnoses or diagnostic testing, treatment, or medication;
Gender-affirming care information;
Reproductive or sexual health information;
Genetic data;
Precise location information that could reasonably indicate your attempt to acquire or receive health services or supplies;
Data that identifies individuals seeking health care services; and
Information that we derive from nonhealth data to associate or identify individuals with any of the categories of Consumer Health Data identified above.
We collect the above categories of Consumer Health Data for the following purposes:
Provide you with our App and respond to your questions or requests concerning the App;
Fulfill the terms of any agreement you have with us;
Fulfill your requests for our App or otherwise complete a transaction that you initiate;
Send you information about our App and other topics that are likely to be of interest to you, including newsletters, updates, or other communications, including promotional emails;
Improve our artificial intelligence and machine learning capabilities;
Deliver confirmations, account information, notifications, and similar operational communications;
Improve your user experience and the quality of our products and App;

From your provider, a mobile health app, or other source of consumer health data if you provide us with permission or authorization to retrieve such information on your behalf.
We may share any of the categories of Consumer Health Data described above. We may share these categories of Consumer Health Data with the following categories of third parties and specific affiliates:
Our service providers and agents in connection with services or business purposes that these individuals or entities perform for, or with, the Company. These third-party service providers can include web-hosting companies, mailing vendors, and analytics providers. We may, for example, provide your Consumer Health Data to a service provider to send you information that you requested.
In some cases, the Company may disclose Consumer Health Data (i) if required to do so by law, court order or legal process, (ii) in response to lawful requests by public authorities, including to meet national security or law enforcement requirements, (iii) under the discovery process in litigation, or (iv) when we believe disclosure is necessary or appropriate to prevent physical harm or financial loss or in connection with an investigation or prosecution of suspected or actual illegal activity. The Company also may transfer Consumer Health Data when a material event concerning its business operation(s), assets or shares, such as purchase, disposal, merger, joint venture or acquisition, is proposed or occurs.
In accordance with applicable law, you may have the following rights in relation to your Consumer Health Data:
The right to confirm whether we are collecting, sharing, or selling your Consumer Health Data;
The right to access your Consumer Health Data, including a list of all third parties and affiliates with whom we have shared or sold the Consumer Health Data and an active email address or other online mechanism that you may use to contact these third parties;
The right to withdraw consent for our collection, sharing, and selling of your Consumer Health Data;
The right to delete your Consumer Health Data; and
The right to correct or amend any Consumer Health Data that we have on file about you.
To exercise any of these rights, please contact us by email at notice@augihealth.com with your name, the email address associated with your interactions with the Company (if different), and details about your interactions with the Company. You may also designate an authorized agent to submit a request on your behalf. To designate an agent, please also send us a written and signed document by both you and the agent that authorizes the agent to act on your behalf. You may also use a power of attorney. Please note that we will still require you to provide sufficient information to allow us to reasonably verify that you are the person about whom we are receiving a request. We will respond to any request you submit in the time period required by applicable law and will allow you to appeal any decision we make in response to such request in accordance with applicable law. Data Security
We have implemented measures designed to secure your personal information from accidental loss and from unauthorized access, use, alteration, and disclosure. All information you provide to us is encrypted and stored in HIPAA compliant cloud servers with multiple layers of security. All financial transactions made in connection with the service will be processed by a third party in accordance with their respective terms of use, privacy policy, and/or any applicable payment terms and conditions. We encourage you to learn about the practices of such third party. In no event will Augi be responsible for the actions or inactions of any third party payment processor.
The safety and security of your information also depends on you. Where we have given you (or where you have chosen) a password for access to certain parts of our App, you are responsible for keeping this password confidential. We ask you not to share your password with anyone.
Unfortunately, the transmission of information via the internet and mobile platforms is not completely secure. Although we do our best to protect your personal information, we cannot guarantee the security of your personal information transmitted through our App. Any transmission of personal information is at your own risk. We are not responsible for circumvention of any privacy settings or security measures included through the App.
Data Retention
